NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED.
1. PROMOTION TIMING: The Stratton Mountain Snow Days Mobile Promotion (the "Mobile Promotion") begins at 12:00 a.m. Eastern Standard Time ("EST") on November 10, 2008 and ends at 5:00 p.m. EST on February 18, 2009 ("Promotion Period"). Administrator's computer is the official time keeping device for the Promotion.
2. HOW TO PLAY THE PROMOTION: There are two (2) ways to enter the Mobile Promotion 1) Text the keyword SKIFREE ("Keyword"), OUTSIDE, SMILE or other keywords may be added that will be listed when available at www.stratton10k.com to 22122 ("Short Code") using your wireless device capable of 2-way text messaging. Once you have properly text messaged the Keyword to the Short Code, you will be notified by a text message if you have won or not. If you have won an instant win prize, you will be notified by a text message that includes a prize code and how to redeem the prize. 2)To enter the Mobile Promotion online visit www.stratton10k.com click on the promotional link and complete all required information. Once you have entered online you will be notified by a text message if you have won or not and if you have won an instant win prize, you will be notified by a text message that includes a prize code and how to redeem the prize. Use of computer programs and other automatic means to participate in the Mobile Promotion is prohibited. Normal Internet access and usage charges imposed by your on-line service provider will apply. Important Notice for Text Messaging: Standard text messaging rates apply. Other charges apply. Your wireless service provider may charge you for each text message you send and receive. You may incur text-messaging charges in connection with attempted play in the Mobile Promotion and corresponding error messages even if the attempted entry does not go through. Entrants are responsible for all fees incurred through their wireless phone service, for text messages or otherwise, associated with participation in this Mobile Promotion. Please consult your wireless service provider regarding their pricing plans. You must be a wireless service subscriber with text messaging service, using a participating service provider in order to enter. Not all cellular phone providers carry the necessary service to participate. This Mobile Promotion is available on Verizon Wireless, T-Mobile, AT&T, Sprint, Nextel, US Cellular, Cellular One, Boost and Virgin Mobile. Check your phone for capabilities for specific text messaging instructions. All entries must be received by 5:00 p.m. EST on February 18, 2009. Regardless of method of entry, limit one (1) entry per person/per day. For the purposes of these Rules, a day is defined as each 24-hour period during the Promotion Period starting at 12:00 a.m. EST and ending at 11:59 p.m. EST, except that the day ends at 5:00 pm EST on February 18, 2009. Any attempt by an entrant to enter more than one (1) time a day by using multiple email addresses or mobile phone accounts will void entrant's plays and entrant will be disqualified. All potential winners are subject to verification before any prize will be awarded. Limit of one (1) prize per entrant throughout Mobile Promotion Period. Any attempt by any entrant to obtain more than one (1) prize by using multiple email address or mobile phone accounts (or via any other method) will void that entrant's plays and that entrant may be disqualified. All prizes need to be claimed and utilized during the 2008/2009 season while the resort is open. The resort closing date is approximately mid-April 2009 but will vary based on weather conditions. After April 1st, be sure to check with the resort to confirm whether it is open. In the event of a dispute over the identity of an entrant, entry will be deemed submitted by the "authorized account holder" of the e-mail address / mobile phone number submitted at the time of entry. The "authorized account holder" is deemed the natural person who is assigned to an e-mail address by an Internet access provider or a mobile phone number by a mobile service provider or other organization that is responsible for assigning e-mail addresses / mobile phone numbers. The winner may be requested to provide Sponsor with proof that he/she is the authorized account holder of the e-mail address / mobile phone number associated with the winning entry.
3. ELIGIBILITY: Open to legal residents of the Continental U.S., excluding residents of Florida, who are eighteen (18) or older as of date of entry. Void in Florida and where prohibited or restricted by law. Employees of Intrawest Corporation, JL Media, g8wave, Inc., their parents, affiliates, subsidiaries, advertising and promotion agencies, including The A Team LLC, and their immediate family members and/or those living in the same household of each are not eligible. All federal, state, and local laws and regulations apply.
4. VERIFICATION: All winners are subject to verification of eligibility. If, due to an error of any kind, more winning prize messages are distributed, or more prizes are claimed than are intended to be awarded according to Section 5 of these Official Rules, the intended number of prizes will be awarded in a random drawing from among all verified prize claims received. In no event will the Sponsor be obligated to award more than the stated number of prizes. Use of automated entry devices or programs is prohibited. Entries generated by script or bot are not eligible.
5. INSTANT WIN PRIZES, ARV AND ODDS OF WINNING (UNCLAIMED/UNREDEEMED INSTANT WIN PRIZES WILL NOT BE AWARDED): (10,000) Instant Win Prizes - A free one (1) -day lift ticket at Stratton Mountain, VT. Lift tickets must be claimed and utilized during the 2008/2009 season while the resort is open. The resort closing date is approximately mid-April 2009 but will vary based on weather conditions. After April 1st, be sure to check with the resort to confirm whether it is open. (ARV of each prize: $80). Total ARV of prizes: $800,000. There will be a total of 10,000 computer-generated winning times, one (1) for each of the prizes, during the Promotional Period. If you are the first player to play the Mobile Promotion at or after one of the randomly generated times, you will be a potential instant winner of the prize indicated. Odds of winning: 1:15. Potential winners must comply with all terms and conditions of these Official Rules and winning is contingent upon fulfilling all requirements.
6. GENERAL RULES: No substitution or transfer of prize permitted by winner except at the sole discretion of the Sponsor. Sponsor reserves the right to substitute a prize of equal or greater value. Prizes must be utilized within time frame specified by Sponsor. Transportation not included with any prizes. All winners will be required to show a government issued identification with a valid photo before claiming their prize. Certain blackout dates and additional restrictions on prizes may apply. All federal, state and local taxes are the sole responsibility of winner. By participating in this Mobile Promotion, entrants agree to be bound by the official rules and the decisions of the judges, which are final and binding. By accepting the prize, winners agree that the Sponsor and those acting under the Sponsor's authority may use winner's name, picture/portrait, likeness and/or hometown, for advertising and promotional purposes without further compensation, unless prohibited by law. By participating, each entrant agrees that the Sponsor, its subsidiaries, affiliates, advertising and promotion agencies, including The A Team LLC, and their respective directors, employees, representatives and agents, will have no liability whatsoever for, and will be held harmless by entrant for any liability for any injury, loss or damages of any kind to persons, including death, and property, due in whole or in part, directly or indirectly, from participation in the Mobile Promotion and the acceptance, possession, use or misuse of a prize in this Mobile Promotion or any prize related activity. Notwithstanding the foregoing, in the event that the preceding release is determined by a court of competent jurisdiction to be invalid or void for any reason, entrant agrees that, by entering the Mobile Promotion, (i) any and all disputes, claims, and causes of action arising out of or in connection with the Mobile Promotion, or any prizes awarded, shall be resolved individually without resort to any form of class action; (ii) any claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Mobile Promotion, but in no event attorney's fees; and (iii) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby waives all rights to claim, punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than damages for actual out-of-pocket expenses. The Sponsor is not responsible for any typographical or other error in the printing of the Mobile Promotion materials or the offering or announcement of the prizes/offers. If for any reason the Mobile Promotion is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure, human error or any other causes beyond the control of Sponsor that corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Mobile Promotion, Sponsor reserves the right in its sole discretion, to cancel, terminate, modify or suspend the Mobile Promotion and award all prizes claimed prior to cancellation. In addition, Sponsor reserves the right in its sole discretion, to disqualify any individual who tampers with the entry process. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. The Sponsor is not responsible for lost, late, incomplete, illegible, mutilated, misdirected entries or for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by Sponsor on account of technical problems or traffic congestion on the Internet or telephone network or lines, any combination thereof, or otherwise, including any injury or damage to entrant's or any other person's computer or mobile phone related to or resulting from participation or downloading any materials in the Promotion. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
